ABSTRACT : The judgments in Sustaining the Wild Coast NPC v Minister of Mineral Resources and Energy highlight the impact of linguistic and cultural translation gaps on the procedural and substantive rights of indigenous communities. This paper examines how these translation gaps, rooted in the Eurocentric orientation of South African civil law, led to a loss of meaning of the rights of affected communities. The paper demonstrates that rights and duties under customary law cannot be equated with their civil law counterparts, as they derive meaning from distinct cultural, linguistic, and spiritual contexts. An overview of the case highlights the exclusion of indigenous communities from decision-making processes, which constituted an infringement of their procedural and substantive rights. This exclusion stemmed from a failure to appreciate the significance of linguistic and cultural diversity in legal contexts. Addressing these challenges requires a multifaceted approach. It involves ensuring legal procedures are culturally sensitive and inclusive.
